Acies Edge, Inc. (“Acies,” “we,” “us,” or “our”) have created this privacy policy (this “Privacy Policy”) because we know that you care about how information you provide to us is used and shared. This Privacy Policy describes our policies and procedures on the collection, use, disclosure, and processing of your information in connection with your use of our website located at https://www.aciesedge.com/ (“Website”) and our services made available through the Website (“Services”).

Description of Users and Acceptance of Terms

This Privacy Policy applies to visitors to the Website, who view only publicly-available content (“Visitors”), customers who have signed up to access and use our Services (“Customers”), and Customer’s employees, contractors, or agents authorized by Customer to access and use our Services (“Authorized Users”). 

By visiting our Website, Visitors are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use.

By accessing and/or using the Services, each Customer and Authorized User is agreeing to the terms of this Privacy Policy, and the accompanying Terms of Use. If you accept or agree to this Privacy Policy and Terms of Use on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to the Privacy Policy and Terms of Use and, in such event, “you” and “your” will refer and apply to that company or other legal entity and any Authorized Users.  

Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use (when such term concerns Visitors), or the SaaS Agreement (when such term concerns Customers and Authorized Users).

The Information We Collect and/or Receives

In the course of operating the Website and providing the Services, we will collect (and/or receive) the following types of information. You authorize us to collect and/or receive such information.

Contact Data

If you would like to use our Services or schedule a demo, you will be asked to provide certain personal information, including but not limited to, email address, first name and last name, phone number, company name, and title (collectively, “Contact Data”). The Contact Data is used to provide the requested service or information and to contact you for purposes of direct marketing of our current and future services.  

Customer Data

In using the Services, Customers and Authorized Users provide us Customer Data. We use the Customer Data (other than any personal information contained therein) in accordance with the terms and conditions of the SaaS Agreement. Any personal information contained in the Customer Data will be used in accordance with this Privacy Policy.

Billing Data

In order to use some of our Services, you will be required to provide certain additional information which may include a credit card number, expiration date, billing zip code, billing address, bank information, and similar information (“Billing Data”). Such Billing Data will be collected and processed by our third party payment processor pursuant to the terms and conditions of its privacy policies and terms of use. We do not directly obtain, store or process any Billing Data.

Usage Data

In an ongoing effort to improve the Website and the Services, we automatically collect certain information when you visit the Website, and/or access or use the Services. This information consists of your IP address (e.g. IP address), browser type, browser version, the pages of our Website and Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access the Website and/or the Services by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit our Website and/or Services or when you access the Website and/or Services by or through a mobile device.

Tracking Technologies and Cookies

We use cookies and similar tracking technologies to track the activity on our Website and Services and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our Website and Services. The technologies we use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on your device. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.   • Web Beacons. Certain sections of our Website and Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

Third-Party Analytics. 

We may use one or more third–party analytics services (such as Google Analytics) to evaluate your use of the Website and the Services, compile reports on activity (based on their collection of IP addresses, Internet service provider, browser type, operating system and language, referring and exit pages and URLs, data and time, amount of time spent on particular pages, what sections of the Website you visit, number of links clicked while on the Website and the Services, search terms and other similar usage data), and analyze performance metrics. These third parties use cookies and other technologies to help analyze and provide us the data. By accessing and using the Website and/or the Services, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. How We Use and Share Your Data

You authorize us to use the Contact Data, Billing Data, Usage Data, and personal information contained in the Customer Data (collectively, the “Information”) for the following purposes:

  • To provide and maintain our Website and Services, including to monitor the usage of our Website and Services.
  • To manage your Account: to manage your account and registration as a user of the Services. 
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services you have purchased or of any other contract with us through the Services.
  • To contact you: To contact you regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

Examples may include providing technical assistance, order fulfillment, customer service, and marketing assistance.  These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law.

Retention of Your Information

We will retain your information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Website or Services, or we are legally obligated to retain this data for longer time periods.

The Website, the Services and their servers are operated in the United States.  If you are located outside of the United States, please be aware that any information you provide to us maybe transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.  If you are located outside the United States and choose to use the Website and the Services, you do so at your own risk.

The security of your Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. We take commercially reasonable steps to protect your Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.  Please understand, however, that no security system is impenetrable.  We cannot guarantee the security of our databases or the databases of the third parties with which we may share such information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet.  In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.  

Children’s Privacy

We do not knowingly collect personal information from anyone under the age of 13. If you are under 13, please do not give us any personal information.  We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal information through the Website, and the Services without their permission.   If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us, and we will endeavor to delete that information from our database. 

Accessing and Modifying Personal Information and Communication Preferences

You may access, review, and make changes to your personal information by contacting us at [email protected]. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any Acies marketing email. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases. 

Links to Other Websites

Our Website and Services may contain links to other websites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Important Notice to California Residents

Acies does not monitor, recognize or honor any opt-out or do not track mechanisms including general web browser, “Do Not Track” settings and/or signals.

Nevada Privacy Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties. You can exercise this right by contacting us at [email protected] with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time, and will post any changes on the Website and the Services as soon as they do into effect. By visiting the Website, accessing and/or using the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes.  Please be aware that, to the extent permitted by applicable law, our use of the information collected is governed by the Privacy Policy in effect at the time we collect the information. Please refer back to this Privacy Policy on a regular basis.
